General Terms and Conditions (GTC) – Gallery arthene
1. Scope
These General Terms and Conditions (GTC) apply to all orders placed via the online shop of Gallery arthene, operated by HHW GmbH, Harald Weingartner, Richard-Wagner-Weg 59, 64287 Darmstadt, Germany. They apply to both consumers and business customers unless a distinction is expressly made.

Withdrawal instruction: You have the right to withdraw from this contract within fourteen days without stating reasons. The withdrawal period is fourteen days from the day you or a third party named by you, who is not the carrier, have taken possession of the goods. To exercise your right of withdrawal, you must inform us (HHW GmbH, Richard-Wagner-Weg 59, 64287 Darmstadt, info@arthene.com) of your decision to withdraw from this contract by means of a clear statement (e.g., email).
Exclusion of withdrawal: The right of withdrawal does not apply to goods that are manufactured according to customer specifications or clearly tailored to personal needs. Since Gallery arthene does not offer commissioned artwork, this exclusion does not generally apply.
3. Conclusion of Contract
By placing products in the online shop, we make a binding offer to conclude a contract for these items. The contract is concluded when the customer clicks the “Buy” button at the end of the order process. Immediately after placing an order, the customer receives an automatic confirmation by email. The contract text is not stored by us and cannot be accessed after completion. The contract language is German.
4. Prices and Shipping Costs
All prices shown include statutory VAT. Additional shipping costs, if any, are displayed during the ordering process. Deliveries are currently made only within Germany. Customs or import charges do not apply for domestic orders.
5. Payment
Payment is made via PayPal. Payment is due immediately upon conclusion of the contract. The order will be processed and shipped after receipt of payment.
6. Delivery
Unless otherwise specified, delivery time within Germany is 3–7 working days after receipt of payment. If an ordered item is unavailable, the customer will be informed immediately and any payments will be refunded.
7. Right of Withdrawal for Consumers
Consumers have a legal right to withdraw from this contract within 14 days without giving any reason.
8. Retention of Title
The goods remain the property of Gallery arthene until full payment has been received.
9. Warranty and Liability
Statutory warranty rights apply. Slight deviations in color, surface or texture may occur due to the artistic and handcrafted nature of the artworks and do not constitute a defect. Liability for damages is excluded except in cases of intent or gross negligence or for damages resulting from injury to life, body or health.
10. Copyright
All artworks, images and texts offered or displayed by Gallery arthene are protected by copyright. Any reproduction, distribution or commercial use without written consent is prohibited.
11. Data Protection
Information on the collection and processing of personal data can be found in our Privacy Policy.
12. Dispute Resolution
The European Commission provides a platform for online dispute resolution (OS): https://ec.europa.eu/consumers/odr. We are not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board.
13. Applicable Law
All contracts are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of mandatory protection under the law of their habitual residence.
14. Final Provisions
Should any provision of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
